QBD 21 October 1989 In this action Bentleys Estate Agents (B) sued Granix (G), a property company , for commission gained by the introduction of a Mr and Mrs Dunn to a maisonette owned by G. B had introduced the Dunns to G and claimed commission. However, G contended that this introduction was in fact made by another firm of estate agents (X). Both estate agents charged G commission and G faced with competing claims and with no direct knowledge of the facts, paid the commission to X, but subject to an undertaking to indemnify G if it should turn out that B were entitled to commission. X had first brought the property to the Dunns` notice, but it was B who persuaded them to view it.
