At court, after the conclusion of the six months, B was granted possession. M appealed, arguing that the tenancy was not assured shorthold as the s20 notice, being issued on the day of commencement, had not been issued before the grant of tenancy; also that the tenancy had been a few hours short of the six months required. "Held" that tenancies deal with years, months and days, not hours, and therefore the tenancy was of sufficient length and that the notice had been issued in advance of its commencement.
