In 1990 the SoS established the buildings as an NHS trust and an agreement was made under which the rights and liabilities under the agreements with F and P were transferred from Y to the trust. Y applied to join the trust as a party to the proceedings to enable it to carry on with proceedings against F and P pursuant to RSC Order 15, r.7(2).
