Appeal by (W) against a County Court decision giving possession to owners of land used for mobile homes . Mobile home occupiers were evicted from a site for which planning permission had been granted in 1963 for use as a caravan site subject to a condition that use should be discontinued in 1977. A site licence was granted at the same time, subject to the same conditions. Site continued to be used in breach of condition after 1977. In 1988 occupiers were given notice to quit. W contested it on the grounds that it was a protected site under the Mobile Homes Act 1983 and Caravans Site Act 1968 . It was held that land without planning permission could not be classed as a protected site; cc decision upheld.
