Claim by plaintiff Muldoon (X) for damages against Mays (Y) relating to alleged negligent advice over valuation of property for sale purposes. In May 1988 Y valued the property at £125,000 and X contracted to sell the property to a Mr and Mrs Scanlon for this sum. The offer was accepted on 27 May with exchange of contracts between X and vendor taking place on 1 July 1988 with completion due on 11 July 1988. After exchanging contracts X learnt of possible development in the area which might give properties a higher value and alleges that the true minimum market value of his property should have been £173,000. Action dismissed on the grounds that there was no evidence that a competent surveyor exercising reasonable care and skill would have arrived at a valuation over and above the £125,000 bracket.
