On the instructions of the defendant, B, the plaintiff firm of estate agents, C, negotiated the sale of a house under which the purchasers paid £53,000 in cash and received another house in part-exchange. C claimed the second house was valued at £56,000 making a total purchase price of £109,000 on which 3% commission had been agreed. C brought proceedings for this commission at the county court. It was held that the purchase price had only been £53,000. C appealed contending that the purchase price included boththe cash and the part exchange element. This was allowed.
