In an earlier action the CA had remitted to the LT an order that W should pay £1m compensation to B for a compulsory purchase. One member of the LT had retired but was consulted by the surviving one who then made the same determination. B appealed on the grounds that the LT was wrong in not giving the parties a second hearing. W agreed that there had been a procedural irregularity, and sought as defence in the present action the production of the LT notes. The court agreed that in the circumstances of long delay it would be appropriate for the notes to be made available and that in future cases full court hearings would be unnecessary.
