The tenants contended that the notice was invalid because it failed to comply with Protection from Eviction Act 1977 s5. The CC held that where primarily agricultural premises are let containing a dwelling-house, the premises are let as a dwelling within the meaning of s5 of the 1977 Act. The landlords appealed. Appeal allowed as the premises were let as an agricultural holding and not as a dwelling.
