Tenant of a retail unit, the plaintiff, changed their trading name from Zales Jewellers Ltd to Ernest Jones Ltd (EJ). The landlord (H), served notice on EJ under Landlord and Tenant Act 1954 S25. The tenant`s solicitor served a counternotice stating that EJ was unwilling to give up possession. H offered EJ alternative accommodation under s30 of the Act. The tenant made an application to the court for a new tenancy but the applicants were named as Signet Group plc (S) and not Ernest Jones Ltd. Once the mistake came to light S made an application for the name to be amended. H appealed contending that the application was outside the time-limit under Landlord and Tenant Act 1954 s29(3). Appeal dismissed.
