Introduces the new Civil Procedure Rules 55 and 56, which will come into force on 15 October 2001 and will change the way in which property litigation is conducted. Rule 55 covers possession claims by landlords, mortgagors or licensors; possession claims against trespassers; applications for relief from forfeiture; and the accelerated possession procedure for assured shorthold tenancies. Rule 56 covers proceedings under the Landlord and Tenant Acts, the Leasehold Property (Repairs) Act 1938, and other statutes concerning land, including leasehold enfranchisement. Sets out the timetable for court action in possession proceedings and the new procedure for lease renewal. Discusses the problems the changes could cause.
