T did not reapply for the tenancies and gave up possession. It was found that T had made false proposals in their section 26 notices ; it was decided that the section 26 notices were not valid and T were not entitled to statutory disturbance payment under s37. T's appeal was allowed as the evidence of a tenant's state of mind was held to be inadmissible and legally irrelevant.
