[2002] EWCA Civ 1568 , 7 November 2002. The appellants' (R) land was subject to compulsory purchase in order for the respondent council (G) to build the Avon ring road. R argued that the compensation should include the value of minerals excavated from the land and used elsewhere by G but it was decided by a Lands Tribunal that the land should be valued on the basis of its agricultural value and not as a commercial mining operation.
