The collapse of a tower crane whilst additional sections of mast were being added to raise the height of the crane, caused three fatalities, serious injury to two others, extensive property damage and delay and disruption to the construction works. CA agreed this operation was under the exclusive control of the owner of the plant, Hewden. Decision implied ther hirer is responsible for loss or damage occuring the period of the hire, except where the plant is in transit, is being erected or dismantled at the site.
