Discusses the case "John Roberts Architects Ltd v Parkcare Homes (No 2) Ltd" ([2005] EWHC 1637 (TCC) unreported) over the payment of parties' costs in the event of a discontinued adjudication. It was decided that since the adjudicator did not make a decision on the matters set out in the notice of the adjudication, he had no jurisdiction to decide the parties' liability for costs. The implication is that the parties' adjudication costs are not recoverable except to the extent that the parties expressly agree.
