Scottish Newcastle v Raguz (L145801) removed the need for landlords to serve protective Landlord and Tenant (Covenants) Act 1995 s17 notices on former tenants and their guarantors where a rent review date has passed but the revised rent has yet to be determined. Tenants facing delayed rent review demands are now challenging arbitration and expert determination on the grounds of procedural irregularity. Looks at the need for a ?term certain? regarding contracting out of Landlord and Tenant Act 1954 Act security of tenure, waiving the right to forfeit a lease, and the extended Carbon Reduction Commitment and green leases.
