"Rydon Homes Ltd v SoS Environment and another" QBD 13 June 1995. Planning permission for residential development was refused because of possible damage by an access road to trees under a TPO. Decision quashed; the inspector had wrongly assumed that the road would have an impervious surface and if he had had different information on this point, a different decision might have been made.
