Vasiliou v SoS for Transport and others CA 12 July 1990. It was held that the SoS for Transport was wrong to authorise the stopping up of a street under Town and Country Planning Act 1971 s209 without consideration of the damage it would do to the appellant` business and to maintain that the appellant should have objected at the planning application stage.
