The recent case lost by the homeowner in the Court of Appeal concerning Humberts ` insurance valuation of a house for the lending institution, but on which the owner of the property misguidedly based the house insurance, implies that the owner of a house must commission an insurance valuation in order that the surveyor owes the property owner a duty of care .
