After a party wall was demolished and reconstructed the respondents claimed settlement and damage, which was confirmed by a third surveyor, to whom the matter was referred. The appeal against his award was transferred to the OR to decide the court`s jurisdiction and if new evidence can be given. London Building Acts (Amendment) Act 1939 s55.
