Watkins Grey International (W) appealed against a CA ruling that damage it caused occurred at the time of a certificate of extension of time and prevented R from obtaining financial recompense from T and that T was not liable in respect for the same damage as W. "Held": the appeal was dismissed on the grounds that the damage was not the 'same damage' for the purposes of the Civil Liability (Contribution) Act 1978 s1(1).
