CA 25 March 2002. G appealed against earlier rulings to strike out two claims for damages for defective work and delays on the grounds of procedural non-compliance. "Held" the appeals were allowed on the grounds that the striking out of the first claim without giving a short extension of time was wholly disproportionate and wrong as it was not one to strike out with the intention of precluding a second claim.
