"Re Leigh Estates (UK) Ltd" ChD 8 December 1993. A petition for the compulsory winding up of a company in receivership which had failed to pay rates on unoccupied property, was dismissed. In seeking to recover rates from the receivers, the council was not acting in the interests of the class of unsecured creditors. The court would not decide on the interpretation of Local Government Finance Act 1988 ss45 and 65(1) and the liability of receivers, following a winding up of the company, to pay the unpaid rates.
