Reports on Ruddick v Ormston ([2005] EWHC 2547 (Ch), 15 November 2005). The claimant (R) recorded the terms of sale for a house owned by O on two pages of his diary, Subsequently O had the house valued for a much larger sum and consequently did not proceed with the sale. R issued proceedings for the court to enforce the contract. "Held": case dismissed. The contract was not enforcable because it did not meet the statutory requirements. However R had not taken unfair advantage of O and owed him no duty to warn that the price he was willing to agree was below market value. O was therefore free to sell the property elsewhere for a higher price.
