B served the appropriate counternotice and applied for a new tenancy . The main point at issue concerned H`s intention to redevelop. Both parties agreed that it would be impossible, during the proposed works, to run the cafe and although B was prepared to take on a tenancy allowing H access and all the facilities to carry out the work, the provisions of s31A on which that offer was made were not satisfied. For s31A to apply it had to be shown that H could carry out the work without interfering to a substantial extent or for a substantial tim
