Cooper v SoS Environment and Harlow DC - 1996 - Property and Compensation Reports [1996] 71 P&CR 529-543(8) .

QBD 21 December 1995. C applied for planning permission for a dwelling on a site which was outside the built-up area of Harlow. Site was shown on the map of the Local Plan as having no notation but an approved Structure Plan relating to the land contained policy S10 which referred to `Rural Areas not included in the Green Belt. However, an associated text referred to `rural areas beyond the green belt`. On appeal, the Inspector concluded that approved policy was set out in S10 rather than associated texts. C challenged this decision. "Held" the proper construction of a development plan was a matter of judgment and therefore it was open to the Inspector to conclude S10 was applicable. Appeal dismissed.
