[2007] CSOH 53, 9 March 2007. A property company sought damages against tenants in a retail development claiming the tenants broke an agreement to keep a store open. The retailers had claimed that the keep-open clause had been breached because of staff intimidation at the store. "Held" the claim was rejected by the judge who said the closure had devalued the shopping centre by 50%.
