Discusses different approaches taken by the English, Australian and Canadian jurisdictions in relation to purely economic loss in the context of defective structures cases. Concludes that whilst there is inconsistent case law and policy and conflicting solutions amongst the major Commonwealth jurisdictions, it is not justifiable to argue that the common law tort of negligence as it relates to defective structure cases is a mess per se.
