Follows the publication of a summary of responses to the first consultation (L132162). The consultation aims to clarify and improve the statutory payment framework, encourage dispute resolution via adjudication and identify how any changes can be evaluated. Proposes to improve access to the right to refer to adjudication. Aims to ensure the costs are fairly allocated. Aims to avoid duplication of payment notices, clarify their content and prohibit pay-when-certified clauses. The statutory right to suspend performance would also be improved. Responses are due by 17 September 2007.
