This information paper looks at the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE). TUPE is the UK's implementation of the European Acquired Rights Directive, and its purpose is to provide employment protection on the transfer of a business from one individual to another, or a change in responsibility for a contracted out service. TUPE may affect property management where there is a "relevant transfer", either where a business or undertaking or part of one is transferred, or when a "service provision change" takes place. The Paper introduces property managers to the main issues surrounding the regulations and provides some practical suggestions.
