The Environmental Liability (Scotland) Regulations 2009 [electronic resource]

These Regulations implement Directive 2004/35/CE of the European Parliament and Council, which relates to environmental liability and the prevention and rectifying of environmental damage to protected species, natural habitats, water and land. The Regulations apply to certain activities and state that where environmental damage may occur, the person responsible must take steps to prevent it and to prevent further damage if some has already occured. Comes into force 24 June 2009.
