"Southway Group Ltd v Wolff and another", CA 16 July 1991, involved a property developer contracting to sell on a building, having first fitted it out. It confirms that in the absence of express provision, the question of whether a contract for services required personal performance by the party that agreed to provide them depended on the common intention of the parties inferred from the nature of the services, the other terms of the contract and all the circumstances of the case.
