Excess soils from development sites are usually considered waste, and a waste management licence or a registered exemption under the Environmental Protection Act 1990 and the Waste Management Licensing Regulations 1994 (as amended) is required for their disposal. However, this document outlines a new regulatory position whereby in certain circumstances, the use of such soils will not require a licence or exemption.
