In Khan v Hamilton , ChD 24 July 1989, the claim by purchaser for breach of contract and damages against the vendor succeeded. The parties had exchanged contracts by telephone for sale of a number of properties. On late receipt of purchaser`s deposit, the vendor rescinded.
