Solicitor`s duty of care - 1994 - Estates Gazette Case Summaries (1994) EGCS 54(1) .

"Haigh and another v Wright Hassall & Co" CA 14 March 1994. Having assured a partner in the defendant firm that a deposit for a property purchase would be forthcoming later in the day, H failed to raise the necessary money and left W with the bill. Faced with a demand for the deposit money, H sued, contending that W had failed in its duty to warn of the consequences of entering a binding contract without funds or written guarantees. CA upheld the earlier decision that a solicitor has no such duty in law, particularly when H appeared sufficiently aware of business practice.
