The National Farmers Union Mutual Insurance Society Ltd v HSBC Insurance (UK) Ltd [electronic resource] - 2010

[2010] EWHC 773 (Comm), 19 April 2010. Both seller and buyer often insure a property between contract exchange and completion in case it is damaged or destroyed during that time. Claimant N insured a £1.81m property on behalf of the buyer and Defendant H on behalf of the vendor to cover the period between contract exchange and sales completion. Fire damaged the building but the deal went through. N sought a contribution from H. "Held": the HSBC policy did not cover the buyer because the NFU policy provided cover for it. No double insurance existed in relation to the buyer and NFU could not be awarded a contribution from HSBC on any basis.
