[2011] EWCA Civ 548, 12 May 2011. Could a buyer of development land rely on a technical breach to free itself from an uncommercial contract? Claimant developer B agreed to purchase a development site from respondent R in 2008. B gave notice to terminate in November 2008 on the grounds that R had not satisfied one of the conditions which it had agreed to meet by July 2008. B appealed against the earlier decision in favour of R. "Held": appeal upheld. R's claim that B had acted in a way that stopped R meeting its responsibility was dismissed. R did not meet a contract condition and B could terminate the contract.
