Referring to relevant caselaw, the author reviews the question of a local authority`s liability for negligence in carrying out its duties under the building regulations made under the Public Health Acts . Discusses the extent of an authority`s duty of care , the damage which proper exercise of that duty of care should prevent (which must relate to the health or safety of the occupants in the house or other building), the extent to which the duty of care is owed and the limitation period involved. The article has not taken account of the provisions of the Latent Damage Act 1986.
