A paper presented at the COBRA Conference in New Delhi on 10-12 September 2013. Presents a comparative analysis of the policies of Portugal and Israel concerning illegal construction. The absence of a special legal framework for non-compliant buildings leads to the use of plan amendments as a means of achieving legalization, the side-effect of which, in both countries, is increased pressure on all levels of the planning system.
