The Law Commission has published a consultation paper "Termination of tenancies for tenant default" setting out proposals to replace the current law of forfeiture of residential tenancies with a statutory scheme. The proposals apply to tenancies of 21 years or more and include the recommendation that if the tenant defaults on the terms of a tenancy, the tenancy can only be ended by a 'termination order' in the courts.
