Argues that the Civil Procedure Rules (CPR) together with recent Court of Appeal decisions has led to uncertainty regarding the law on expert reports. With particular reference to CPR 35.10 which appears to negate the privileged status of instructions to experts, he observes that an opportunity to consider the rule was side-stepped in "Lucas v Barking, Havering and Redbridge Hospitals NHS Trust" [2003] 2003 EWCA Civ 1102; [2004] 1 WLR 220".
