The Construction Industry Council has published "Novation agreement CIC/NovAgr2" (ISBN 1 898671 36 2), a standard form of agreement for use where the appointment of a consultant is to be novated from an employer to a design and build contractor. Guidance notes are included in the agreement and a "Supplemental agreement CIC/NovAgr/Ewa" is freely downloadable from http://www.cic.org.uk/liability/index.htm. The supplemental agreement is for use where, following the novation of a consultant from an employer to a design and build contractor, a warranty is given by the consultant to the employer.
