Reports on the latest efforts of the OFT to reduce the incidents of price-fixing. Notes that the UK's anti-cartel rules are contained in the Competition Act 1998 and the Enterprise Act 2002. The Enterprise Act has made the existing rules even tougher and introduces US-style criminal sanctions for serious cartel activities. Makes the distinction between two forms of co-operating in the tender process. Collusive tendering which occurs when competitors decide to collaborate without informing the procuring organisation is stricly prohibited. Joint bidding or tendering, where potentially competing tenderers openly submit a joint bid to the procurer, may be permissible.
