Examines the recent case, "AWG Construction Ltd v Rockingham Motor Speedway Ltd" ([2004] EWHC 888 (TCC), [2004] TCLR 6.Here the two parties were in adjudication, but disagreements surfaced with AWG accusing R of placing new material and arguments which were very difficult to reply to. The adjudicator awarded £1.8m to R but the judge overturned this. The results of the adjudication lacked jurisdiction as issues outside of the dispute had been referred to. This had widened the issue, turning it into a different dispute. Argues that adjudicators should continue to allow further submissions but they should be within a strict timetable.
