Top lawyers and mediators have argued that, judges need to be trained in mediation. The issue has been highlighted following "Halsey v Milton Keynes General NHS Trust" ([2004] EWCA (Civ) 576, [2004] ALL ER CD) 125 (May)), where it was established that a party can refuse to mediate, but the judge had to decide whether the case had a chance of success at mediation.
