The Anti-Social Behaviour Act 2003 Part VIII is due to come into force later this year. It is hoped that it will provide a new complaints procedure for those adversely affected by high hedges. Under Part 8 of the Act an owner or occupier can make a complaint that the height of a hedge interferes with the reasonable enjoyment of his domestic property whereas before a right to light was associated with a building or window. Sets out the difference between the old regime and new one and outlines the limitations of the new procedure. Concludes that the success of the new system will depend on the speed of the local authority to deal with the complaints.
