A current review of the Housing, Grants Construction and Regeneration Act 1996 is dispensing with the concept of due. Initially, the Act attempted to clarify what is due and when in order to enable a debt to crystallise. However, in practice peppering the Act with the term due tended to frustrate the process by which payment is achieved.
