Security on the benefit of a prelet

Woolf, G.

Security on the benefit of a prelet - 2004 - Estates Gazette (0441) 9 October 2004, 150(1) .

Considers issues for lenders where they need to enforce an assigned obligation on a tenant. Where an interest in any property is charged, the whole of the landlord's interest as charger does not pass to the lender. The landlord's interest in the property continues and he always has the right to have it back once the lender discharges its charge.
