Kilmartin SCI (Hulton House) Ltd v Safeway Stores

[2006] EWHC 60 (Ch), 27 January 2006. Considered an agreement for a lease made between K and S. The premises comprises of the basement and ground floor of Hulton House in Fleet Street, London which was to be leased by S as a small city-centre supermarket. The takeover of S by Morrisons PLC prompted the decision that the premises were no longer required. S then attempted to terminate the agreement by stating that the premises did not attain a minimum net internal area. This claim was however, disproved when the premises was measured as defined by the RICS "Code of measuring practice'. "Held" : Judgment in favour of K.
