"Without prejudice" documents and privilege

In Rush and Tompkins Ltd v Greater London Council and P J Carey Plant Hire (Oval) Ltd ., CA 21 December 1987, the court allowed an appeal by the second defendant subcontractors and ordered specific discovery by Rush and Tompkins of " without prejudice " correspondence between Rush and Tompkins and the GLC. The correspondence had been brought into existence in order to reach a settlement with the GLC.
