CA 25 April 1996. C freehold owners of a building containing residential flats. M, who held a lease for a second floor flat and an attic storeroom served a notice under the Leasehold Reform Housing and Urban Development Act 1993 s42 claiming a right to a new lease of the flat and the storeroom. C`s application to have the storeroom excluded from the new lease was dismissed. C appealed. "Held" storeroom was an appurtenance within s62(2) of the 1993 Act. Accordingly, M was entitled to a new lease which included the storeroom. Appeal dismissed.
